Rockefeller

OKs Bill on

Death Law

ALBANY, N. Y„ May 6 <AP).

—The mandatory death pen

alty was on the way out in

New York State today in a

move that could lead to abol

ishment of capital punishment

in the State.

A controversial bill lifting

the automatic death sentence

in premeditated murder and

kidnaping cases was among the

last group of measures ap

proved by Gov. Nelson A.

Rockefeller on the eve of his

marriage.

The bill sets up a two-stage

trial procedure that will per

mit juries to decide first

whether an accused person is

guilty and, if so, then to de

termine whether he should be

put to death. It will apply to

trials begun after July 1.

The bill was the product of

studies by the temporary State

commission on revision of the

penal law. Ihe group has been

examining the entire question

of capital punishment but has

said it is nX ready yet to

recommend whether it should

be dropped or retained.
