SummaryResumen
An importer claims exemption from United States duty on certain sugars and products from San Domingo based on a treaty with the Dominican Republic requiring import duties no higher than those charged on products from any other country, comparing it to the duty-free status granted under the treaty and act with Hawaii. The United States maintains that the Hawaiian treaty is a commercial contract involving valuable consideration rather than a mere reciprocity treaty. Counsel argues that a defeat for the U.S. could make San Domingo the "Honolulu of the Atlantic coast," while a U.S. victory could lead multiple foreign governments to shut out American manufactures without violating existing treaties of equality, thereby upsetting nearly all U.S. commercial treaties.

duty under a special act of Congress, ap
proved Aug. 15,1876.
About twenty years ago the United
States entered into a treaty with the
Dominican Republic by the terms of which
each country agreed not to charge higher
import duties on products ol the other
than were imposed upon like products
from any other country. The importer
claims exemption from duty lor certain
sugars and other products imported by
him from San Domingo upon the ground
that the articles were ot such character
that had they been imported trom Hawaii
they would have been admitted tree ol
duty under the treaty between the United
States and Hawaii aud the act ot August
15th, 1876. The United States maintains
that the treaty with the Hawaiian Islands
is not a mere reciprocity treaty, but is
substance a commercial contract, by virtue
of which Hawaii pays a valuable consider
ation for the admission of certain merchan
dise to ports of the United States.
The counsel for the importer says if the
United States should be defeated in this
case, San Domingo might become the Hono
lulu of the Atlantic coast, while if the
United States should succeed, Denmark,
Brazil, Central America, Fern, Persia and
other foreign governments would be at
liberty to shut American manufactures and
products from their ports without giving
us any cause for complaint for a violation
of existing treaties pledging the United
States an equality there with all other na
tions. This, they say, would upset nearly
all our existing commercial treaties with
foreign powers.
Heavy Snow Storm.
